EverGreen Recreational Vehicles – $1.2 Million Settlement

On July 15, 2016, we filed suit in the United States District Court for the Northern District of Indiana against EverGreen Recreational Vehicles, LLC (“EverGreen”), KR Enterprises, Inc. (“KR”), and JMA, LLC, (“JMA,” and together with EverGreen and KR, “Defendants”) seeking to recover 60 days wages and benefits for former employees under the Worker Adjustment and Retraining Notification (“WARN”) Act. We contend Defendants ordered mass layoffs on or about June 8, 2016, without providing the employees with advance written notice.

On December 10, 2019, the Court granted final approval of a class action settlement in the amount of $1.2 million. Settlement checks, net of class counsel’s fees, expenses and applicable withholding, were mailed to members of the class on January 22, 2020.
