HomeBanc Mortgage – $1.75 Million Settlement

On August 21, 2007, Raisner Roupinian LLP filed suit against HomeBanc Mortgage Corporation, HomeBanc Corp., HomeBanc Funding Corp., HomeBanc Funding Corp. II, HMB Acceptance Corp., and HMB Mortgage Partner, LLC (“HomeBanc Mortgage”) seeking to recover 60 days wages and benefits for former employees under the Worker Adjustment and Retraining Notification (“WARN”) Act. We contend HomeBanc Mortgage ordered mass layoffs on or about August 10, 2007, without providing its employees with advance written notice.

On October 17, 2016, the Court granted final approval of a class settlement of $1.75 million, inclusive of attorneys’ fees and expenses. Once sufficient funds are available in the HomeBanc Estate to fund the WARN settlement, the Trustee will mail settlement checks to the members of the class.
